I am the aggrieved Afzal Khan..the CLB ignored the circumstance that the preemption clause of the Articles of the Company prohibited any manner of transfer of share as was done by my father Ayub Khan in adding the names of Mehboob and Yasmin my step siblings , using his clout as director of the company. This could not be challenged at the time as my shares were wrongfully withheld by my father and was under a suit of in HC no 4400, where the Honble court granted an Injunction on such transfers upholding the preemption clause as applicable to all shares of the Company. The error of CLB chairman cost me subsequent appeals as he was biased, and mentioned malafide intent. This went against me. My Admin Suit is pending in High Court where by Justice OKa’s order despite the transfer of shares under CLB Order , the final outcome of Suit would determine the rightful ownership as per Islamic Shariat Act.
